 One-count information was filed in U.S. District Court in
Philadelphia, Pennsylvania, charging S.D. Carruthers
Sons, Inc. of Argyle, New York, with rigging bids, in
violation of Section 1 of the Sherman Act, for certain
polyurethane foam contracts in New York and
Massachusetts, beginning at least as early as July 1987
and continuing at least into August 1990.  Polyurethane
foam is a material used in roofing projects.
 
 |  | 11/18/92 | U.S. v. Edgar Allen Spears and Young's Food Stores, Inc. Criminal No.:  3:92-553 (D.S.C.)
 Four-count indictment was filed in U.S. District Court in
Columbia, South Carolina, charging Edgar Allen Spears and
Young's Food Stores, Inc., both of Sumter, South
Carolina, with rigging bids, in violation of Section 1 of
the Sherman Act, submitted to various school districts in
South Carolina for the award and performance of contracts
to supply dairy products to the public schools in those
school districts (Count One).  Counts Two, Three and Four
each charge Spears and Young's with separate violations
of the mail fraud statute, 18 U.S.C. § 1341, by knowingly
causing the U.S. Postal Service to deliver three payments
from Florence County School District 3 to Sumter Dairies,
Inc., Young's predecessor corporation, for the supply of
milk to the public schools in that district pursuant to
the 1987/1988 school year contract awarded to Sumter
Dairies on the basis of collusive bids.

 One-count information was filed in U.S. District Court in
Tyler, Texas, charging Kenneth L. Bullard, zone manager
of Cabell's Dairy, then a division of The Southland
Corporation and later a subsidiary of Morningstar Foods,
Inc., with rigging bids, in violation of Section 1 of the
Sherman Act, for the award and performance of contracts
to supply fluid milk to public school districts located
in Smith, Cherokee, Wood, Upshur, Kaufman, Van Zandt,
Anderson, Henderson and Rusk Counties, Texas.

 One-count information was filed in U.S. District Court
Buffalo, New York, charging Accent Stripe, Inc. of
Orchard Park, New York, with rigging bids, in violation
of Section 1 of the Sherman Act, for certain highway
pavement marking contracts in New York State, beginning
at least as early as March 1990 and continuing at least
until March 1991.  Highway pavement marking companies
apply reflective material such as paint, epoxy and
thermoplastic to roads and highways to form stripes,
lines and other traffic control indicators. |
