Treasury’s former General Counsel, David Aufhauser, assumed responsibility for overseeing these efforts, which he exercised through lawyers that reported directly to him. Upon Mr. Aufhauser=s departure from Treasury, Arnold I. Havens was nominated to be General Counsel by President Bush and confirmed by the Senate on December 9, 2003. Mr. Havens advises that he has determined that he will implement the same management approach for ensuring that Treasury continues to implement its document retention and litigation responsibilities in Cobell. Brian Ferrell will continue to report directly to the General Counsel on this matter and assist in keeping the Court informed on matters relating to Treasury in this litigation.
