ON FDA'S AUTHORITY TO REGULATE TOBACCO

The Solicitor General today authorized the filing of a petition in the U.S. Court of Appeals for the Fourth Circuit seeking rehearing en banc of the three-judge panel's decision in the case of Brown & Williamson Tobacco Corporation v. Food and Drug Administration.
