FOR IMMEDIATE RELEASE CR FRIDAY, MARCH 31, 1995 (202) 616-2765 TDD (202) 514-1888 MEDIA ADVISORY WASHINGTON, D.C. -- The Solicitor General of the United States today approved the filing of an appeal of a decision two weeks ago by a U.S. District Court in Milwaukee holding the FACE law unconstitutional. On March 16, District Court Judge Rudolph T. Randa found that Congress had no power to enact the Freedom of Access to Clinic Entrances Act under either the Commerce Clause or the 14th Amendment of the Constitution. Seven District Courts and the Fourth Circuit Court of Appeals have upheld the constitutionality of FACE. Six of the District Courts and the Fourth Circuit specifically considered the Commerce Clause issue in reaching their decisions. The Justice Department anticipates filing a Notice of Appeal on Monday. # # # 95-179
