Fitzgerald, Special Counsel, and Peter R. Zeidenberg, Deputy Special Counsel, having moved the Court for an Order requiring LAWRENCE ARI FLEJSCHER to testify pursuant to Title 18, United States Code, Section 6001, in regard to a matter to be presented to the Federal Grand Jury that is, In re: John Doe, Grand Jury 03-3-5, and to provide such information at any other proceeding ancillary to the above- styled matter, and being advised that the request for immunity was approved by the Special Counsel, United States Department of Justice on February 11, 2004, and that the testimony and other information from this witness may be necessary to the public interest, and furthermore, such individual has refused to testify or provide other information on the basis of his/her privilege against self-incrimination, it is hereby ORDERED that LAWRENCE ART FLEISCHER be required to testify and provide other information in regard to a matter to be presented to the Federal Grand Jury, that is In re: John Doe, Grand Jury 03-3-5, and to provide such information at any other proceeding ancillary to the 1  << GX05102 >> above-styled matter. Provided, that said LAWRENCE ART FLEISCHER is hereby granted immunity from the use against LAWRENCE ARI FLEISCHER in any criminal case of any testimony or other information compelled under such order, or any information directly or indirectly derived from such testimony or other information, except that the above does not immunize the said LAWRENCE ARI FLEISCHER against charges of perjury, giving a false statement or otherwise failing to comply with the Order of the Court.
