CRIMINAL DEFENSE ATTORNEY PLEADS GUILTY TO FAILING TO FILE TAX RETURN FOR YEAR HE EARNED MORE THAN $4 MILLION

 A criminal defense attorney who earned more than $4 million in 1994 pleaded guilty today to a charge of willfully failing to file his income tax return for that year.
 David E. Kenner, 60, whose law offices are in Encino, pleaded guilty before United States District Judge Florence M. Cooper in Los Angeles.
 By pleading guilty today, Kenner admitted that he earned $4,085,539 in gross income and that he should have reported $3,027,690 in adjusted gross income in 1994. Kenner was required to file his personal income tax return, at the latest, by October 15, 1995, but he failed to file his return that year. Kenner also failed to file his return after he was advised on February 13, 1997, that he was under criminal investigation. Kenner finally filed his tax return on December 2, 1997.
 Judge Cooper is scheduled to sentence Kenner on April 29.  At the time of sentencing, Kenner faces a maximum penalty of one year in federal prison and a fine of $100,000. He may also be ordered to pay additional taxes due.
 This case is the product of an investigation by the Internal Revenue Service, Criminal Investigation.
