BURLINGTON MAN SENTENCED FOR FILING FALSE TAX RETURN Kevin J. O'Connor, United States Attorney for the District of Connecticut, announced that THOMAS R. CARBONE, age 43, of 201 Johnnycake Mountain Road, Burlington, Connecticut, was sentenced today by United States District Judge Christopher F. Droney to six months of home confinement with electronic monitoring and a $10,000 fine. CARBONE pleaded guilty in June 2003 to one count of filing a false income tax return under the penalties of perjury. CARBONE's tax return omitted approximately $140,000 in taxable income earned during calendar year 1997. During the guilty plea proceeding, CARBONE admitted in court that he was the sole owner of Omnitrend, Inc., a computer software firm that he operated from his home, and that during calendar years 1995 through 1997 he filed personal tax returns and returns for Omnitrend. The returns understated earned income and overstated deductions resulting in a total underpayment of income taxes for himself and Omnitrend of $171,051 for those years. CARBONE has now paid more than $300,000 in taxes due along with penalties and interest for his personal income and Omnitrend, and has entered an installment agreement to pay another $100,000 in penalties and interest for Omnitrend. In imposing sentence, Judge Droney departed downward from the United States Sentencing Guidelines, noting that CARBONE's presence at home was necessary to care for his wife, who suffers from serious medical problems. "This case is an example of the ongoing efforts of our office in conjunction with the Internal Revenue Service to ensure compliance with our tax laws," U.S. Attorney O'Connor stated. "We will vigorously prosecute all who avoid their obligations to pay their fair share of taxes." The case was investigated by the Internal Revenue Service, Criminal Investigation, and was prosecuted by Assistant United States Attorney Peter A. Clark. | |
