DFW EMPLOYER SENTENCED IN FEDERAL COURT

Alfonso Anile Indicted Following DFW Airport Sweep Last Year

United States Attorney Jane J. Boyle announced that DFW airport employer, Alfonso Anile, of Euless, Texas, was sentenced yesterday in Fort Worth, by Terry R. Means, United States District Judge, to 21 months imprisonment and ordered to pay $207,656.04 restitution to the Internal Revenue Service to cover taxes owed. Anile, age 60, was ordered to surrender to the Bureau of Prisons no later than June 7, 2004.

Anile and co-defendant Jack Dempsey Cromer, of Bedford, Texas, owned equal percentages of DFW Café, Inc., which since 1997, operated cafeteria-style restaurants at DFW International Airport. Both Anile and Cromer pled guilty last year to felony fraud and tax-related charges. Both pleas stemmed from a November 20, 2002, multi-agency task force security sweep at DFW International Airport designed to remove employees who used wrongful means to gain access to secure areas of the airport. Specifically, Alfonso Anile pled guilty to aiding and abetting one of his many illegal alien employees use a false Social Security Number to obtain a security badge that would allow access to secure areas of the airport. Cromer pled guilty to a felony tax count charging that he failed to collect, truthfully account for, and pay taxes on several DFW Café, Inc. employees. Cromer, age 62, is scheduled to be sentenced by Judge Means on May 24, 2004.

At today's sentencing hearing, the government presented testimony that Anile admitted during an interview that both he and Cromer paid these illegal alien employees with cash to conceal the employees' illegal status and that they knew the use of cash payments resulted in no taxes being paid for these illegal alien employees. Judge Means noted that the failure to pay taxes on all employees was clearly wrong and resulted in an increased tax burden on other law abiding citizens.

U.S. Attorney Boyle praised the joint investigative efforts of the Federal Bureau of Investigation, Internal Revenue Service - Criminal Investigation, Bureau of Immigration and Customs Enforcement, Bureau of Customs and Border Protection, Social Security Administration-OIG, and the Dallas/Fort Worth International Airport Department of Public Safety. This case is part of a continuing effort to improve security at our nation's airports by prosecuting both employees and employers using unlawful means to gain access to airport facilities.
