AVON MAN CHARGED WITH FILING FALSE TAX RETURN AND CLAIM FOR REFUND

Kevin J. O’Connor, United States Attorney for the District of Connecticut, announced that a federal grand jury sitting Hartford has returned a two-count Indictment charging GARY DAVIS, age 52, of 30 Somerset Drive, Avon, Connecticut, with filing a false tax return and making a false claim to the United States in the amount of $430,571. The Indictment was returned yesterday, March 23.

The Indictment alleges that, on April 14, 2000, DAVIS knowingly filed a U.S. Individual Income Tax Return (Form 1040) stating, incorrectly, that $430,831 of federal income tax had been withheld and paid to the Internal Revenue Service (IRS). The Indictment further alleges that DAVIS then fraudulently claimed a refund of taxes in the amount of $430,571.

As a result of this indictment, DAVIS is subject to a maximum term of imprisonment of eight years and a fine of up to $350,000.
U.S. Attorney O’Connor stressed that an indictment is only a charge and is not evidence of guilt. The defendant is entitled to a fair trial at which it is the Government’s burden to prove guilt beyond a reasonable doubt.

This case is being investigated by the Internal Revenue Service - Criminal Investigation and is being prosecuted by Assistant United States Attorney David Ring.
