STATE MARSHAL PLEADS GUILTY TO FEDERAL TAX CHARGE

Kevin J. O’Connor, United States Attorney for the District of Connecticut, announced that JOHN B. McGUIRE, age 62, of 135 Phillips Rd., Lisbon, Connecticut, pleaded guilty today to a federal charge of making and subscribing a false tax return. United States District Judge Christopher F. Droney accepted McGUIRE’s plea of guilty this afternoon in Hartford.

On April 13, 2004, a federal grand jury sitting Hartford returned an Indictment charging McGUIRE with three counts of making and subscribing false tax returns. Today, McGUIRE pleaded guilty to Count One of the Indictment.

According to documents filed with the Court and statements made in court, McGUIRE is a former Deputy Sheriff in New London County and currently a State Marshal. During the years 1997, 1998 and 1999, McGUIRE, in his capacity as a deputy sheriff, provided professional services in connection with legal proceedings, including serving legal papers and carrying out wage executions and evictions. McGUIRE today admitted that, in his tax returns for those years, he reported that his gross receipts from his sheriff’s business were $14,556, $13,086 and $13,689, respectively. However, McGUIRE’s gross receipts for those same years were in fact $90,109.96, $69,595.30 and $56,411.83, respectively. McGUIRE’s understatement of his gross receipts for the tax years 1997 through 1999 resulted in a tax loss to the Government of $45,803.

“We all have an obligation to pay our taxes, and individuals who are sworn to uphold the law have a special responsibility to do so,” U.S. Attorney O’Connor stated.

Judge Droney has scheduled sentencing for July 22, 2005 at which time McGUIRE faces a maximum term of imprisonment of three years and a fine of up to $250,000.

This case was investigated by the Internal Revenue Service - Criminal Investigation Division and is being prosecuted by Assistant United States Attorney Dave Vatti.
