KILLINGWORTH MAN PLEADS GUILTY TO TAX EVASION
Accountant also admits to embezzling more than $500,000 from Norwalk medical group

Kevin J. O’Connor, United States Attorney for the District of Connecticut, today announced that DAVID E. MONTESI, age 46, formerly of Killingworth, Connecticut, pleaded guilty today to income tax evasion. United States Magistrate Judge Donna F. Martinez accepted MONTESI’S plea of guilty today in Hartford federal court.

According to documents filed with the Court and statements made in court, MONTESI, formerly employed as an accountant with a firm in Norwalk, admitted that, in September 2000, he attempted to evade the payment of a large part of the income tax owed by him and his spouse for the calendar year 1999 by filing a false and fraudulent amended joint U.S. Individual Income Tax Return, Form 1040. Specifically, MONTESI acknowledged the he stated on the return that their joint taxable income for the calendar year 1999 was $46,048, and that the amount of tax due and owing was $6,616 when, in fact, their joint taxable income for that year was $220,020. By omitting this additional income, MONTESI evaded the payment of $56,272 for that calendar year.

During the course of the investigation, it was learned that, over several years, MONTESI had embezzled $550,520 from a Norwalk medical practice and failed to pay taxes on the unreported stolen funds. As a condition of his plea agreement, MONTESI has agreed to pay $177,461 in federal taxes he evaded paying from 1997 to 2000, plus penalties and interest.

MONTESI is scheduled to be sentenced on November 7, 2005, by Chief United States District Judge Robert N. Chatigny, at which time he faces a maximum term of imprisonment of five years and a fine of up to $250,000.

“The obligation to pay federal income taxes is fundamental to operation of government, and those who do not meet their tax obligations cheat their neighbors and their Country,” U.S. Attorney O’Connor stated.

This case was investigated by the Internal Revenue Service - Criminal Investigation and is being prosecuted by Assistant United States Attorney David X. Sullivan.
