Guilty Plea Entered for Inmate Who Filed a
False Claim Against the Government

Memphis, TN David Kustoff, United States Attorney for the Western District of Tennessee, announced today that Frank L. Tate, 49, an inmate of the West Tennessee State Penitentiary, pled guilty before U.S. District Judge Bernice B. Donald to one count of filing a false claim against the government.  Tate will be sentenced later this year.  Tate was indicted on February 6, 2006, charged with 21 counts of filing false claims with the Internal Revenue Service.  These claims were filed in the names of Frank Tate and others between February 12, 2001 and February 25, 2002, and claimed more than $48,100 in tax refunds.  The indictment states that Tate knew that the taxpayers identified in the returns were not entitled to an income tax refund because the information contained in the returns was false and fictitious.

 

This investigation was conducted by IRS Criminal Investigation. Assistant U.S. Attorney Joe Murphy represented the government.
