Mexican National Sentenced for Second Aggravated Illegal Reentry into the United States
DAVENPORT, IA – On August 24, 2012, Ruben Perales Avila, a Mexican national formerly of Davenport, Iowa, was sentenced to 96 months imprisonment for aggravated illegal reentry into the United States, announced United States Attorney Nicholas A. Klinefeldt. Chief United States District Judge James E. Gritzner ordered Perales’ sentence be served consecutively to a previous sentence of 18 months for violating the terms of his federal supervised release.
In 1997, Perales, then a lawful permanent resident of the United States, was stripped of this status by the Immigration and Naturalization Service based on convictions in Scott County, Iowa, District Court for child molestation offenses. Perales was ordered deported from the United States.
Perales illegally reentered the United States in about 2000 and was arrested in 2002. In 2003, he was sentenced in United States District Court to 71 months for aggravated illegal reentry into the United States. In 2008, after completing his term of imprisonment, Perales again was deported.
Within a few months of his deportation, Perales again illegally reentered the United States, and in early 2009 he was arrested by Davenport police and charged with extortion. After serving a term of imprisonment in the Iowa Department of Corrections, Perales was returned to federal custody in 2011 and charged with violating the federal sentence of supervised release imposed in 2003. He was sentenced to 18 months imprisonment for violating the terms of supervised release.
In May 2011, Perales was indicted in United States District Court for the second, aggravated illegal reentry to the United States, resulting in 96 month sentence imposed today.
The case was investigated by the United States Department of Homeland Security, and prosecuted by the United States Attorney’s Office for the Southern District of Iowa.
