WEEK IN REVIEW – SOUTH BEND

 

 

                South Bend, Indiana -- The United States Attorney’s Office announced that:

 

DISPOSITIONS:

 

  Ø   Larry E. Roth, 46, of South Bend, Indiana, was sentenced by Judge Robert Miller, Jr. to 27 months imprisonment and 3 years of supervised release after pleading guilty to the felony offense of possession of a firearm by a convicted felon.  Roth was ordered to pay $23,031.87 in restitution to the victim in this case. 

 

According to the sentencing memorandum filed by the government, Roth has prior felony convictions for non-support of dependent child (C felony) 2006; and felony marijuana sale and possession of cannabis less than 20 grams, Pasco County, Florida, 1984. The defendant also has misdemeanor convictions in 1984, 1987, 1992, 1996, 2000, 2006, and 2009 and has at least thirteen other arrests.

 

On May 5, 2011, the victim was shot in the neck and mouth when a loaded handgun belonging to defendant Larry Roth discharged while the two were at the home of Roth in South Bend, Indiana.  Roth was showing the gun to the victim when it accidentally discharged.

 

This case was the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms, and Explosives.  This case was prosecuted by Assistant United States Attorney Donald Schmid.

 

  Ø   Renato Debartolo, 45, of New Carlisle, Indiana, was sentenced by Judge Robert Miller, Jr. to 25 months imprisonment and 4 years of supervised release after pleading guilty to the felony offense of manufacture of more than 100 marijuana plants.

 

According to the sentencing memorandum filed by the court, on January 2011, police inspecting a suspected theft of utility service found that Renato DeBartolo was using the stolen electricity for a marijuana grow operation.  This case was the result of an investigation by the Drug Enforcement Administration.  This case was prosecuted by Assistant United States Attorney Frank Schaffer.

 

  Ø   David Nowak, 68, of South Bend, Indiana, was sentenced by Judge Robert Miller, Jr. to 48 months imprisonment and lifetime supervised release after pleading guilty to the felony offense of possession of child pornography.  

 

According to the sentencing memorandum file by the court, on March 2011, law enforcement authorities found the equivalent of 4,528 images of child pornography on David Nowak’s computer storage. Mr. Nowak told the investigators he had been collecting child pornography since the beginning of the internet. 

 

This case resulted from an investigation by members of the Indiana Internet Crimes Against Children Task Force, including the Federal Bureau of Investigation.  This case was prosecuted by Assistant United States Attorney John Maciejczyk.

 

  Ø   Corey Rucker, 30, of South Bend, Indiana, was sentenced by Judge Jon DeGuilio to 27 months imprisonment and 10 years of supervised release after pleading guilty to the felony offense of failure to register as a sex offender. 

 

According to the sentencing memorandum filed by the government in this case, the defendant moved to Indiana and established a new residence without registering as a sex offender, and this offense occurred after the defendant had previously been convicted of a state felony offense for failing to register as a sex offender in Kane County, Illinois. 

 

This case resulted from an investigation by members of the Indiana Internet Crimes Against Children Task Force, including  the United States Marshal's Service and the South Bend Police Department. This case was prosecuted by Assistant United States Attorney John Maciejczyk.
