FEDERAL GRAND JURY IN SOUTH BEND RETURNS INDICTMENTS

 

 

South Bend, IN—The United States Attorney's Office announced that a Grand Jury sitting in South Bend, Indiana, returned the following Indictments on June 14, 2012:

           

  Ø   Cedric D. Washington, 31, of South Bend, Indiana, was charged in a one count Indictment with felon in possession of a firearm.  These charges were filed as the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms, and Explosives.  This case has been assigned to and will be prosecuted by Assistant United States Attorney Jesse M. Barrett.

 

  Ø   Adam Engels, 26, address unknown, was charged in a one count Indictment with escape from an institutional facility.  These charges were filed as the result of an investigation by the United States Marshall Service.  This case has been assigned to and will be prosecuted by Assistant United States Attorney Frank E. Schaffer.

 

  Ø   Dale Hite, age 26, of Plymouth, Indiana, was charged in a one count Indictment with conspiracy to manufacture controlled substances/aiding and abetting.  These charges were filed as the result of an investigation by the Drug Enforcement Administration.  This case has been assigned to and will be prosecuted by Assistant United States Attorney Frank E. Schaffer.

 

  Ø   Maria Rodriguez, 19, of Elkhart, Indiana, was charged in a one-count Indictment with misuse of a social security number.  These charges were filed as a result of an investigation by the St. Joseph County Sheriff’s Department (Indiana) and U.S. Department of Homeland Security - Immigration and Customs Enforcement.  This case has been assigned to and will be prosecuted by Assistant United States Attorney Barbara Z. Brook.

                       

  Ø   Robert E. Miller, 59, of South Bend, Indiana, was charged in a one-count Indictment with attempting to evade and defeat the payment of income tax.  This charge was filed as a result of an investigation by the Internal Revenue Service and Federal Bureau of Investigation.  This case has been assigned to and will be prosecuted by Assistant United States Attorney Donald J. Schmid.

 

  Ø   Brian S. Newman, 45, of Michigan City, Indiana, was charged in a six count Indictment with: three counts of production and attempted production of child pornography; one count of extortion; one count of receipt of child pornography; and one count of possession of child pornography.  This case resulted from an investigation by members of the Indiana Internet Crimes Against Children Task Force, including the Federal Bureau of Investigation, the Michigan City Police Department, the Mound Police Department, Mound, Minnesota, Cary Police Department, Cary, North Carolina, Arcadia Police Department, Arcadia, California; and the New York State Police.  This case has been assigned to and will be prosecuted by Assistant United States Attorney John M. Maciejczyk.

 

This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Led by United States Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. If convicted in court, any specific sentence to be imposed will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines. .

 

The United States Attorney's Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.
