SHAWN C. BRADLEY, age 47 and resident of Norco, Louisiana, pled guilty yesterday before U. S. District Judge Jay C. Zainey for making false statements to the Department of Labor, announced U. S. Attorney Jim Letten. Additionally, the defendant’s company, BRADLEY ELECTRICAL SERVICES, INC., a Louisiana corporation located in Norco, also plead guilty to a misdemeanor charge of violating federal overtime provisions.

According to court documents, SHAWN C. BRADLEY is owner and operator of BRADLEY ELECTRICAL SERVICES, INC., The DOL Wage and Hour Division had conducted an investigation of BRADLEY ELECTRICAL and had determined that BRADLEY ELECTRICAL failed to pay 59 employees approximately $74,931.29 in overtime wages. Subsequently, SHAWN BRADLEY, as the owner and operator of BRADLEY ELECTRICAL, signed an agreement with the Wage and Hour Division agreeing that BRADLEY ELECTRICAL would pay the full amount of back wages due. BRADLEY personally agreed in writing to mail the proof of payments to the Wage and Hour Division by October 31, 2006. However, instead of mailing the proof of payments, on November 29, 2006, SHAWN C. BRADLEY, directed a company employee to hand deliver 54 proofs of payment to the Wage and Hour Division office located in New Orleans, Louisiana, reflecting that the individuals listed on the 54 proofs of payment had been paid in full. SHAWN BRADLEY admitted in court today that he knew that thirty-eight of the forms were false in that BRADLEY ELECTRICAL had not paid these employees all their back wages and that they were owed approximately $62,082.06.

BRADLEY faces a possible maximum penalty of five (5) years imprisonment and a $250,000 fine. The company faces a possible maximum fine of $100,000. Sentencing has been scheduled for November 16, 2010.

This investigation was conducted by the U.S. Department of Labor, Wage and Hour Division, and prosecuted by Assistant U. S. Attorney Dorothy Manning Taylor.
