NESTOR ALEJANDRO GONZALEZ-BAUTISTA, age 27, a citizen of Mexico, pled guilty in federal court yesterday before U. S. District Judge Jay C. Zainey to count one of an indictment charging him with making a false statement to a federal agency, announced U. S. Attorney Jim Letten.

According to court documents, on February 18, 2010, GONZALEZ, knowingly and willfully made a false writing and document containing materially false statements and entries in that he prepared a written form as part of his application for Transportation Worker Identification Credentials (TWIC), and signed that form, certifying and stating that he was a citizen or national of the United States, and therefore, met the requirements for issuance of a TWIC card, when in fact, he knew he was not a citizen or national of the United States and was unlawfully present in the United States, and he did not satisfy the requirements for issuance of a TWIC card, all in a matter within the jurisdiction of the Transportation Security Administration.

GONZALEZ faces a maximum term of imprisonment of five (5) years, a fine of $250,000.00 and three (3) years of supervised release following any term of imprisonment. Sentencing is set for October 4, 2011.

The case was investigated by the U. S. Department of Homeland Security, Homeland Security Investigations (HSI). The case is being prosecuted by Special Assistant U. S. Attorney Robert Weir.
