PROJECT CEASEFIRE
JURY CONVICTS CARROLLTON MAN
OF ILLEGAL FIREARM
KANSAS CITY, Mo. – Beth Phillips, United States Attorney for the Western District of Missouri, announced that a Carrollton, Mo., man was convicted by a federal jury today of illegally possessing a firearm.
Michael C. Moylan, 29, of Carrollton, was found guilty of being a felon in possession of a firearm. Moylan was in possession of a Hi-Point 9mm rifle on Dec. 21, 2009.
Moylan was arrested when law enforcement officers were called to his residence on Dec. 21, 2009, on a report of a domestic disturbance involving a firearm. A woman told officers that Moylan had put a gun to her head. Officers entered the residence and found Moylan sitting on the couch. The rifle was found lying on the ground under the porch.
Under federal law, it is illegal for anyone who has been convicted of a felony to be in possession of any firearm or ammunition. Moylan has a prior felony conviction for unlawful use of a weapon.
Following the presentation of evidence, the jury in the U.S. District Court in Kansas City deliberated approximately three hours before returning the guilty verdict to U.S. District Judge Greg Kays, ending a trial that began Monday, June 14, 2010.
Under federal statutes, Moylan is subject to a sentence of up to 10 years in federal prison without parole, plus a fine up to $250,000. A sentencing hearing will be scheduled after the completion of a presentence investigation by the United States Probation Office.
This case is being prosecuted by Assistant U.S. Attorney Paul S. Becker. It was investigated by the Carrollton, Mo., Police Department, the Carroll County, Mo., Sheriff’s Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
Project Ceasefire
Project Ceasefire, launched in October 1999, is a cooperative initiative by federal and local law enforcement and the Kansas City Crime Commission that targets for federal prosecution persons who unlawfully use or possess firearms.
