Las cruces man sentenced for escape
United States Attorney Kenneth J. Gonzales announced that yesterday, Gabriel Valdivia, 25, of Las Cruces, was sentenced to 23 months of imprisonment on charges stemming from an October 1, 2010, escape. According to a criminal complaint filed on October 22, 2010, Valdivia, who was serving a 24-month sentence for a supervised release violation, failed to return to the Diersen Charities halfway house in Albuquerque, New Mexico.
On November 3, 2010, Valdivia pled guilty to an information charging him with escape, in violation of 18 U.S.C. § 751(a). Yesterday, United States Senior District Judge John E. Conway sentenced Valdivia to 15 months of imprisonment on the escape charge and an additional 8 months of imprisonment for a violation of Valdivia’s conditions of supervised release. The court imposed consecutive sentences, for a total term of imprisonment of 23 months. The court also imposed a three-year term of supervised release.
This case was investigated by the United States Marshal’s Service, and Assistant United States Attorney Jake Wishard is the prosecutor assigned to the case.
