Mexican citizen arrested on immigration charges held on provisional arrest warrant for murder in canada
United States Attorney Kenneth J. Gonzales announced that earlier today, Luis Alfonso Ochoa-Gamez, 30, of Mexico, was sentenced to time served (96 days) and a year of supervised release on an immigration charge. Ochoa-Gamez remains in custody on a provisional arrest warrant for murder. On November 16, 2010, authorities in Alberta, Canada filed 2nd degree murder charges against Ochoa-Gamez. According to a complaint for a provisional arrest warrant filed in United States District Court on December 3, 2010, Ochoa-Gamez is accused of shooting and killing the victim in Shaughnessy, Alberta over a drug deal. The federal court issued a provisional arrest warrant for Ochoa-Gamez on December 10, 2010. Formal extradition proceedings are pending.
United States Customs and Border Protection agents arrested Ochoa-Gamez on October 16, 2010, at the Santa Teresa Port of Entry as he attempted to return to Mexico. Ochoa-Gamez previously had been deported from the United States on October 5, 2007. On October 18, 2010, a criminal complaint was filed charging Ochoa-Gamez with illegal reentry of a deported alien. Ochoa-Gamez pled guilty to that charge on November 1, 2010.
The case is being prosecuted by Assistant United States Attorney Nathan J. Lichvarcik. A criminal complaint is only an accusation. All criminal defendants are presumed innocent until proven guilty beyond a reasonable doubt.
