Mexcalero man pleads guilty to assault resulting in serious bodily injury
LAS CRUCES -- United States Attorney Kenneth J. Gonzales announced that Kaul Ray Duffy, 23, of Mescalero, New Mexico, pled guilty to assault resulting in serious bodily injury earlier today in Las Cruces before United States Magistrate Judge William P. Lynch. Duffy admitted that he assaulted his girlfriend on March 20, 2010, by choking and beating her.
Duffy, who is an enrolled member of the Mescalero Apache Tribe, was arrested on October 28, 2010, and has been in custody since his arrest. According to the criminal complaint, Duffy assaulted the victim in her residence during a three-hour period, strangling her and threatening to kill the victim and himself.
Under the terms of the plea agreement, Duffy will receive a sentence of five years of imprisonment to be followed by three years of supervised release.
This case was investigated by the Bureau of Indian Affairs and is being prosecuted by Assistant United States Attorney Mick Gutierrez.
