Albuquerque man sentenced to 30-Month prison term for federal firearms conviction
ALBUQUERQUE -- This afternoon, Chief United States District Judge Bruce D. Black sentenced Albuquerque resident Thomas Bernard Elder, 23, to 30-months imprisonment to be followed by a two-year term of supervised release based on his conviction for being a felon in possession of a firearm and ammunition. Elder has been in federal custody since his arrest on August 25, 2009. On February 22, 2010, Elder entered a guilty plea to a one-count indictment charging him as a felon in possession of a firearm and ammunition under a plea agreement with the United States Attorney's Office.
According to the indictment, Elder was convicted of armed robbery and conspiracy to commit armed robbery in the Second Judicial District Court for the State of New Mexico and thus was prohibited from possession firearms and ammunition. Despite his prior convictions, Elder was in possession of a firearm and ammunition on November 4, 2008.
Assistant United States Attorney Kimberly A. Brawley prosecuted the case, which was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives.
