Mescalero Man Sentenced to Ten Years for Shooting at a Residence in Mescalero

LAS CRUCES – United States Attorney Kenneth J. Gonzales announced that earlier today, Frank Bow Gallerito, 39, of Mescalero, New Mexico, was sentenced to ten years of imprisonment for assault with a deadly weapon and discharging a firearm in connection with a crime of violence. Gallerito pled guilty to the charges on February 7, 2011, and admitted that on September 24, 2009, he fired a .45 ACP pistol into the victim’s home on the Mescalero reservation.

According to the criminal complaint, the victim, his wife and two small children were in the home at the time Gallerito fired approximately eight rounds at the house. The criminal complaint alleged that three bullets entered the house through the front window, and bullets were recovered in the kitchen wall and the door frame of the children’s bedroom. Gallerito was arrested on September 25, 2009, and initially charged in Mescalero Apache Tribal Court. He has remained in custody since his arrest.

This case was investigated by the Federal Bureau of Investigation in Las Cruces, and the Bureau of Indian Affairs, and was prosecuted by Assistant United States Attorney Jacob A. Wishard.
