Grand Jury Returns Superseding Indictment Against Garner
ALBUQUERQUE – United States Attorney Kenneth J. Gonzales announced that today, a federal grand jury sitting in Albuquerque returned a superseding indictment against Kevin Garner, 43. The superseding indictment modifies the original indictment against Garner by alleging that he distributed more than five grams of actual methamphetamine on February 17, 2010. Based on the allegations in the superseding indictment and Garner’s prior narcotics trafficking conviction, Garner now faces a mandatory minimum ten-year and a maximum life term of imprisonment and a maximum $4 million fine if convicted.
As previously reported, Garner was indicted by on December 28, 2010 and arrested on December 29, 2010. He is detained pending trial based on a judicial finding that he poses a danger to the community and risk of flight.
This case was investigated by the Drug Enforcement Administration and the Albuquerque Police Department, and is being prosecuted by Assistant United States Attorneys Joel R. Meyers and Jon K. Stanford.
Charges in indictments are only accusations. All criminal defendants are presumed innocent unless proven guilty beyond a reasonable doubt.
