Fairview Man Receives 46-Month Prison Sentence for Heroin Trafficking Conviction

SANTA FE – Chief United States District Judge Bruce D. Black sentenced Allen Roger Martinez, 49, a resident of Fairview, New Mexico, to 46-months imprisonment to be followed by a three year term of supervised release based on his heroin trafficking conviction. Martinez also was ordered to pay restitution in the amount of $2000.00. Martinez has been in federal custody since his arrest on June 9, 2010.

United States Attorney Kenneth J. Gonzales announced that Martinez was arrested based on an indictment charging Martinez and co-defendant Antonio Ocampo-Ochoa, 26, with conspiracy to distribute heroin (count 1) and heroin distribution (count 2). The indictment also separately charged Martinez with an additional distribution of heroin (count 3) and Ocampo-Ochoa, a Mexican national, with re-entry of a removed alien (count 4).

On August 9, 2010, Martinez entered guilty pleas to counts 1 through 3 of the indictment under a plea agreement with the United States Attorney’s Office. In his plea agreement, Martinez admitted that he sold heroin to a Special Agent of the Drug Enforcement Administration who was acting in an undercover capacity. Specifically, Martinez admitted selling 49.3 grams of heroin to the undercover agent on April 27, 2010 for $2,000, and selling 74.3 grams of heroin to the agent on May 15, 2010 for $3,000. The heroin sales took place in Espanola, New Mexico.

Antonio Ocampo-Ochoa has entered a not guilty plea to the indictment and is detained pending trial. United States Attorney Gonzales notes that an indictment is only an accusation and that Ocampo-Ochoa is presumed innocent unless and until proven guilty beyond a reasonable doubt.

Assistant United States Attorney Samuel A. Hurtado prosecuted this case, which was investigated by the Drug Enforcement Administration.
