Previously Deported Mexican National Receives 68 Month Prison Sentence for Unlawful Re-Entry into United States and Violating Federal Firearms Laws
SANTA FE – Earlier today, Chief United States District Judge Bruce D. Black sentenced Jose Agustin Villagomez-Saucedo, 30, to a 68-month term of imprisonment based on his convictions for re-entering the United States without authorization and after having previously been deported and federal firearms offenses. Villagomez-Saucedo will be deported after completing his prison sentence.
United States Attorney Kenneth J. Gonzales said Villagomez-Saucedo was arrested on April 27, 2010 at his residence in Edgewood, New Mexico after the United States Border Patrol, U.S. Department of Homeland Security, determined that he was a previously deported alien. He has been in federal custody since that time. Immigration records reflect that Villagomez-Saucedo, who hails from Morelia, Michoacan, Mexico, had previously been deported from the United States to Mexico at San Ysidro, California on June 29, 2001. This deportation occurred subsequent to his January 1999 conviction for assault with a deadly weapon, an aggravated felony.
Villagomez-Saucedo was indicted on May 26, 2010 and charged with (1) re-entry of a removed alien, (2) illegal alien in possession of a firearm, and (3) felon in possession of a firearm. A superceding indictment alleging the same offenses was filed on August 25, 2010. VillagomezSaucedo entered a guilty plea to the three counts in the superseding indictment on September 29, 2010.
Assistant United States Attorney Paige Messec prosecuted the case, which was investigated by the United States Border Patrol, U.S. Department of Homeland Security.
