February 23, 2007 - United States Attorney Patrick L. Meehan and District Attorney Lynne Abraham today announced the filing of an indictment* charging DENNIS HICKS, with possession of heroin with intent to distribute, in violation of 21 U.S.C.§ 841(a)(1), (b)(1)(C); possession of a firearm by a convicted felon, in violation of 18 U.S.C. § 922(g) and 924(e); and possession of a firearm in furtherance of a drug trafficking crime, in violation of 18 U.S.C. § 924(c)(1)(A), all on or about August 13 2006, in Philadelphia, Pennsylvania.

The indictment charges that the defendant possessed one Smith and Wesson 9MM pistol loaded with several live rounds of 9MM caliber ammunition, after being convicted of a felony. The indictment further charges that the defendant possessed heroin with intent to distribute and possessed the Smith and Wesson 9MM pistol in furtherance of that drug trafficking crime.

If convicted of all charges, defendant Hicks faces a total maximum sentence of life imprisonment, a 20 year mandatory minimum term of imprisonment, 6 years supervised release and a $2,000,000 fine.

This case was investigated by the Philadelphia Police Department and the Bureau of Alcohol, Tobacco & Firearms. This case is part of Project Safe Neighborhoods, a federal initiative designed to identify and prosecute firearms offenders in federal court, where the defendant is likely to receive a substantial sentence upon conviction.
