GREENEVILLE, Tenn-- A federal grand jury in Greeneville returned a 17-count indictment on September 14, 2010, against Michael Norman Dube, 48, of Johnson City, Tennessee, for obtaining controlled substances by misrepresentation, fraud, forgery, deception or subterfuge and omitting material information from records required to be kept under the Controlled Substances Act. Dube appeared in court on September 20, 2010, before U.S. Magistrate Judge Dennis Inman and entered a plea of not guilty to the charges in the indictment. Dube was released pending trial, which has been set for November 23, 2010, in United States District Court, in Greeneville, Tennessee.

The indictment alleges that from October 2006 through May 2008, Dube obtained by misrepresentation, fraud, or subterfuge hydrocodone with acetaminophen, oxycodone, and buprenorphine (Suboxone) on sixteen separate occasions. The indictment further alleges that Dube knowingly and intentionally omitted material information from records required to be kept under the Controlled Substances Act. If convicted, Dube faces terms of up to four years imprisonment and $250,000 in fines on each count.

Dube was first licensed to practice medicine in Tennessee in 1996. His medical license was suspended in 2009.

This indictment is the result of an investigation by Drug Enforcement Administration’s Office of Diversion Control with assistance from the Tennessee Bureau of Investigation. Assistant U.S. Attorney Neil Smith will represent the United States.
