ANOTHER MEMBER OF BANK ROBBERY GANG INDICTED United States Attorney Richard B. Roper announced that a federal grand jury in Lubbock, Texas, has returned a superseding indictment today that charges former Amarillo, Texas, resident, Ivin Darrell Wozencraft with conspiracy to commit bank and credit union robbery and aggravated bank robbery. Wozencraft, age 41, is the fifth defendant to be charged as part of a gang that committed a string of bank and credit union robberies in Lubbock from April 2004 to January 2006. The superseding indictment also charges Amarillo residents James Edward Peacock, age 62, David Aaron Johnson, age 22, James Glen Horton, age 39, and Erica Nicole Edwards, age 22, with various felony offenses related to the robberies. A federal grand jury originally indicted these four defendants last month. All five defendants are in custody. The four defendants originally indicted have entered not guilty pleas at their arraignments. Presently trial is set to begin the first week of May. Specifically, James Edward Peacock, David Aaron Johnson and Ivin Darrel Wozencraft were charged with committing the following aggravated bank robberies: • April 21, 2004 City Bank • May 14, 2004 State National Bank • July 20, 2005 Peoples Bank Defendants Peacock, Johnson, and Horton were charged with committing the following aggravated credit union robbery and using and carrying a firearm during and in relation to a crime of violence: • October 19, 2005 Plains Bell Federal Credit Union Defendants Peacock, Johnson, and Edwards were also charged with committing the following aggravated credit union robbery and using and carrying a firearm during and in relation to a crime of violence: • January 26, 2006 Plains Bell Federal Credit Union An indictment is an accusation by a federal grand jury and a defendant is entitled to the presumption of innocence unless proven guilty. However, if convicted on all counts, James Edward Peacock and David Aaron Johnson face a minimum statutory sentence of 32 years and a maximum statutory sentence of life imprisonment; James Glen Horton, and Erica Edwards each face a minimum statutory sentence of 7 years and a maximum statutory sentence of life imprisonment. Ivin Darrel Wozencraft faces a maximum statutory sentence of 50 years imprisonment. Each could be ordered to pay a fine and restitution. U.S. Attorney Roper praised the investigative efforts of the Federal Bureau of Investigation, the Lubbock Police Department, and the Amarillo Police Department. The case is being prosecuted by Assistant United States Attorney Jeffrey R. Haag. ###
