GARLAND, TEXAS, MAN ARRESTED ON
CHILD PORNOGRAPHY CHARGES

U.S. Attorney Richard B. Roper announced that Garland, Texas, resident, Kimberly Layne Johnson, was arrested this morning on charges outlined in a federal indictment returned earlier this month in Dallas. The two-count indictment charges him with one count each of receipt of child pornography and possession of child pornography. Mr. Johnson appeared before United States Magistrate Judge Paul D. Stickney this afternoon who ordered him detained pending trial. He will be arraigned before United States District Judge Sidney A. Fitzwater on February 2, 2007.

According to the indictment, between January 25, 2006 and February 2, 2006, Johnson used the Internet to download movie files and still images of minors engaged sexually explicit conduct. The indictment also alleges that on July 27, 2006, Johnson possessed a CD-Rom that contained several visual depictions of minors engaged in sexually explicit conduct.

If convicted on both counts of the indictment, Mr. Johnson, age 48, faces a maximum statutory sentence of at least five years and not more than 30 years imprisonment and a $500,000 fine.

An indictment is an accusation by a federal grand jury and a defendant is entitled to the presumption of innocence unless proven guilty.

U.S. Attorney Roper commended the investigative efforts of the U.S. Immigration and Customs Enforcement (ICE). The case is being prosecuted by Assistant United States Attorney Aisha Saleem.
