DYESS AIR FORCE BASE AIRMAN ARRESTED ON FEDERAL CHARGES
FOR MAKING FALSE STATEMENTS TO PURCHASE FIREARMS

 

LUBBOCK, Texas — A federal grand jury in Lubbock returned an indictment yesterday charging Porfirio Jose Sevilla-Urbina, 25, an Airman stationed at Dyess Air Force Base, near Abilene, Texas, on charges of making false statements during the purchase of firearms, announced U.S. Attorney James T. Jacks of the Northern District of Texas. Sevilla-Urbina was arrested today by federal agents and is scheduled to make his initial appearance on Monday, December 13, 2010, in federal court in Abilene before U.S. Magistrate Judge Philip R.Lane.

According to the 15-count indictment, on 15 separate occasions, from July 2, 2009, to March 13, 2010, Sevilla-Urbina provided what he knew to be incorrect information on the ATF Form 4473, Firearms Transaction Record, while purchasing firearms in Abilene, Rockwall, Greenville, Queens City, Dallas and Mesquite, Texas.

An indictment is an accusation by a federal grand jury and a defendant is entitled to the presumption of innocence unless proven guilty. However, if convicted, each of the counts carries a maximum statutory sentence of five years in prison and a $250,000 fine.

The case is being investigated by the ATF and prosecuted by Deputy Criminal Chief Assistant U.S. Attorney Denise Williams of the U.S. Attorney’s Office in Lubbock.
