Thank you for taking the time to solicit comments on the fund rules.
My main concern is when families review the chart to see the "award" then deduct
"collateral" sources, it leaves nothing for many of the families.
Families who had life insurance & pension plans should not be "punished" by the
fund. A court of law would never deduct life insurance & pensions from any
settlements, so the fund shouldn't either!
I suggest that you go back to congress & have them amend the law to deduct
collateral sources from the awards.
I also suggest that you set up a guaranteed minimum for all families who will
receive nothing after deducting collateral sources.
I calculated my families award, then deducted life insurance & pensions and it
left my family with ZERO. As a result, I am getting the paperwork ready to file
a lawsuit against the airlines. This is a prime example of the aggravation that
the fund has caused my family. Either we accept ZERO from the fund or file a
very winnable lawsuit against the airlines.
Unless the law to deduct collateral sources is amended, I feel that many
families will also file lawsuits.
Isn't this what you were trying to stop in the first place?
