On April 1, 2014, a superseding indictment was returned in the U.S. District Court for the Western District of Texas charging Michael Baker and Michael Gluk with one count of conspiracy to commit wire and securities fraud, 9 counts of wire fraud and two counts of securities fraud. The indictment also charges Baker with three counts of false statements.
