Dear Mr. Kuykendall:

     The Department of Justice is in receipt of your letter
seeking a clarification of the date when structural changes
necessary to provide program access must be completed.  

     You have correctly noted the two dates for completing
compliance activities that are contained in our title II
technical assistance manual.  As it so happens, both are
incorrect.  Pursuant to our regulation, title II entities are
required to complete their structural changes within three (3)
years of the effective date of the regulation.  That effective
date is January 26, 1992.  Therefore, structural changes in
existing facilities necessary to comply with title II's
provisions must be completed by January 26, 1995.  (28 C.F.R.
{35.150(c)).
     
     Your attention to the requirements of title II is
appreciated.
