The United States Attorney's Office for the District of Colorado represents the United States and its agencies in civil and criminal litigation before the United States District Court for the District of Colorado and on appeal before the United States Court of Appeals for the Tenth Circuit. The office prosecutes federal criminal offenses, litigates affirmative and defensive civil lawsuits, and collects judgments and restitution for victims and taxpayers. Job Description

The U.S. Attorney's Office is accepting applications for the position of an Assistant United States Attorney as the primary eLitigation attorney in the Office. This AUSA will be responsible for building and overseeing the office's eLitigation operations and helping the Office advance the Department of Justice's priority of achieving and maintaining eLitigation proficiency among attorneys and staff. The attorney must be devoted to justice, excellence, and fairness.

This AUSA will be responsible for advising and consulting on substantive eLitigation and discovery issues with case teams from the office's Civil, Criminal, and Asset Recovery Divisions and with management. The AUSA will also interact on eLitigation issues with other entities such as the courts, the Federal Public Defender, law enforcement, and client agencies. This advice and consultation may include ensuring that discovery processes are proper and defensible; further developing the office's eLitigation policies and protocols, including procedures for processing, reviewing, producing, and managing electronic discovery; working directly with law enforcement agencies to improve their electronic evidence collection and production; coordinating litigation support work; and working with the Office's Senior
Litigation Counsel to provide training on litigation technology software tools and applications. The selected candidate will serve as an attorney advisor who will be fully dedicated to coordinating the office's eLitigation program. This is not a trial AUSA position; the AUSA will not be assigned cases and will have minimal direct involvement in litigation of particular cases. The AUSA will be located in the Denver office but will work with the district's branch offices as well and will report directly to the First Assistant U.S. Attorney.

The attorney must have the interest and aptitude to gain and maintain expertise on developments in the law, in technology and software, and in best practices related to eLitigation. The attorney also must have the ability to identify creative solutions to difficult eLitigation problems, write and speak clearly and persuasively, analyze complex legal and factual issues, exhibit good organizational skills, exercise sound judgment, work well both independently and on an inclusive team with attorneys and staff of all backgrounds, negotiate effectively with other parties, and, overall, handle matters with integrity on behalf of the people of the United States of America.

Responsibilities will increase and assignments will become more complex as your training and experience progress.
 

Qualifications

Required Qualifications:

Applicants must possess a J.D. Degree, be an active member of the bar (any U.S. jurisdiction), and have at least 1 year post-J.D. legal or other relevant experience.
United States citizenship is required.

Preferred Qualifications:
Highly desired are: at least three years' experience with complex civil or criminal litigation and with using litigation technology applications, such as Relativity, Eclipse, and Everlaw, to acquire, organize, analyze and present electronic discovery and evidence; experience working with privilege logs and protective orders; experience working with government agencies; superior oral and written communication skills; the ability to manage multiple projects simultaneously; and the ability to work well both independently and on teams.

Suitability and Citizenship:  It is the policy of the Department to achieve a drug-free workplace and persons selected for employment will be required to pass a drug test which screens for illegal drug use prior to final appointment.  Employment is also contingent upon the completion and satisfactory adjudication of a background investigation. Congress generally prohibits agencies from employing non-citizens within the United States, except for a few narrow exceptions as set forth in the annual Appropriations Act (see, https://www.usajobs.gov/Help/working-in-government/non-citizens/). Pursuant to DOJ component policies, only U.S. citizens are eligible for employment with the Executive Office for Immigration Review, U.S. Trustee’s Offices, and the Federal Bureau of Investigation. Unless otherwise indicated in a particular job advertisement, qualifying non-U.S. citizens meeting immigration and appropriations law criteria may apply for employment with other DOJ organizations. However, please be advised that the appointment of non-U.S. citizens is extremely rare; such appointments would be possible only if necessary to accomplish the Department's mission and would be subject to strict security requirements. Candidates must have lived in the United States for at least three of the past five years. The three-year period is cumulative, not necessarily consecutive. This is a Department security requirement which is waived only for extreme circumstances and handled on a case-by-case basis.

Veterans:  There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Justice considers veterans' preference eligibility as a positive factor in attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., the DD 214, Certificate of Release or Discharge from Active Duty and other supporting documentation) to their submissions. Although the "point" system is not used, per se, applicants eligible to claim 10-point preference must submit Standard Form (SF) 15, Application for 10-Point Veteran Preference, and submit the supporting documentation required for the specific type of preference claimed (visit the OPM website, www.opm.gov/forms/pdf_fill/SF15.pdf for a copy of SF 15, which lists the types of 10-point preferences and the required supporting document(s). Applicants should note that SF 15 requires supporting documentation associated with service- connected disabilities or receipt of nonservice-connected disability pensions to be dated 1991 or later except in the case of service members submitting official statements or retirement orders from a branch of the Armed Forces showing that their retirement was due to a permanent service-connected disability or that they were transferred to the permanent disability retired list (the statement or retirement orders must indicate that the disability is 10% or more).
