Job Description

The United States Attorney's Office for the Western District of North Carolina is accepting applications for an Assistant United States Attorney in our small but dedicated appellate division. If selected, you will be responsible for a high volume of criminal appeals before the Court of Appeals for the Fourth Circuit and post-conviction matters before the United States District Court for the Western District of North Carolina. Although you should be prepared to work efficiently and independently, you'll routinely collaborate with others in the division, editing briefs and helping others prepare for oral arguments, among other things. You'll also work closely with colleagues in the office's criminal and civil divisions, providing training, consulting about legal issues, and providing regular updates on developments in the law.

Qualifications

Applicants must possess a J.D. Degree, be an active member of the bar (any U.S. jurisdiction), and have significant appellate experience, either as an advocate or as an appellate law clerk.

The work requires a capacity to function with minimal supervision in a highly demanding work environment. It requires superior communication, courtroom, and oral-advocacy skills. It requires strong interpersonal and professional skills. It requires an ability to work with other attorneys, support staff, and client agencies in a professional manner. It requires a strong desire to practice in North Carolina. And it requires strong legal-research, legal-analysis, and writing skills. A genuine enthusiasm for good writing and oral advocacy is critical.

Your education and experience should demonstrate that you possess each of these skills.

United States citizenship is required.

Preferred Qualifications:

We expect a good match for this position will have a few additional qualifications. We have a strong preference for candidates with experience as a federal appellate law clerk. And we'll give serious consideration to the recommendation of a judge familiar with the applicant's work. Candidates with experience presenting appellate oral arguments and experience representing parties in trials or evidentiary hearings are likely to be a particularly good match for the position. We won't exclude you from consideration if don't have all of these preferred qualifications. But be prepared to explain how your experience demonstrates that you possess the skills the job requires.

Suitability and Citizenship:  It is the policy of the Department to achieve a drug-free workplace and persons selected for employment will be required to pass a drug test which screens for illegal drug use prior to final appointment.  Employment is also contingent upon the completion and satisfactory adjudication of a background investigation. Congress generally prohibits agencies from employing non-citizens within the United States, except for a few narrow exceptions as set forth in the annual Appropriations Act (see, https://www.usajobs.gov/Help/working-in-government/non-citizens/). Veterans:  There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Justice considers veterans' preference eligibility as a positive factor in attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., the DD 214, Certificate of Release or Discharge from Active Duty and other supporting documentation) to their submissions. Although the "point" system is not used, per se, applicants eligible to claim 10-point preference must submit Standard Form (SF) 15, Application for 10-Point Veteran Preference, and submit the supporting documentation required for the specific type of preference claimed (visit the OPM website, www.opm.gov/forms/pdf_fill/SF15.pdf for a copy of SF 15, which lists the types of 10-point preferences and the required supporting document(s).
