About the Office

The Employment Law Unit provides direct representation of the FBI in personnel-related administrative hearings and coordinates the FBI's representation in civil suits arising from personnel-related matters.  This posting is for an attorney position which is embedded in the FBI’s Security Division.  The incumbent will provide legal advice to FBI management on security clearance denials and revocations and defend those decisions on appeal before the DOJ Access Review Committee.  The incumbent will provide legal advice to the Security Division on the other security related programs it administers.

Job Description

GS-14:

  • Provide legal advice to all levels of Security Division management in personnel security and other security related programs administered by the Security Division of the FBI. 
  • Defend the FBI in all phases of the security clearance denial and revocation appeals process.
  • Assist in representing the FBI in personnel-related litigation in administrative actions and the federal courts of the United States in cases involving personnel security matters.

GS-15: In addition to the above duties:

  • Provide expert legal advice and guidance to the highest levels of FBI management on all aspects of personnel security, physical security, document security, communications security, information security and related issues.

Positive Education Requirement

This position has a specific education requirement; all applicants must verify completion of this basic educational requirement by submitting a copy of their Law school transcripts by the closing date of the vacancy announcement.

Applicant must possess a J.D. degree from a law school accredited by the American Bar Association (or have an LLM degree or other graduate law degree in addition to a J.D.) and be an active member of the bar (any US jurisdiction).

Education completed in foreign colleges or universities may be used to meet the above requirements provided you can show foreign education is comparable to that received in an accredited educational institution in the United States.

 

Basic Requirement:

All applicants must possess a law degree from a law school accredited by the American Bar Association, and be an active member of the bar (any US jurisdiction).



Specialized Experience (SE):

GS-14: Applicants applying for the GS-14 must also have 2.5 or more years post J.D. attorney experience.

  • Experience in participating in interpreting and analyzing legal issues.

GS-15: Applicants applying for the GS-15 must also have 5 or more years of post J.D. attorney experience.

  • Experience demonstrating proficiency in interpreting and analyzing complex legal issues.

 

Desired Skills :

Desired skills are NOT mandatory and will NOT be utilized to minimally qualify applicants.

Desired Skills are: 

The ideal candidate will possess five years of substantive experience in personnel security or related security fields.  Experience defending executive branch agencies in federal sector EEO cases, including experience practicing before the MSPB, is beneficial.

Veterans:  There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Justice considers veterans' preference eligibility as a positive factor in attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., the DD 214, Certificate of Release or Discharge from Active Duty and other supporting documentation) to their submissions. Although the "point" system is not used, per se, applicants eligible to claim 10-point preference must submit Standard Form (SF) 15, Application for 10-Point Veteran Preference, and submit the supporting documentation required for the specific type of preference claimed (visit the OPM website, www.opm.gov/forms/pdf_fill/SF15.pdf for a copy of SF 15, which lists the types of 10-point preferences and the required supporting document(s). Applicants should note that SF 15 requires supporting documentation associated with service- connected disabilities or receipt of nonservice-connected disability pensions to be dated 1991 or later except in the case of service members submitting official statements or retirement orders from a branch of the Armed Forces showing that their retirement was due to a permanent service-connected disability or that they were transferred to the permanent disability retired list (the statement or retirement orders must indicate that the disability is 10% or more).
