Congressional Oversight & Investigations Unit (COIU) provides legal support and guidance to FBI entities, including the Office of Congressional Affairs (OCA) and Inspection Division (INSD) regarding the FBI's engagements with and responses to Congress and external reviews and investigations. The mission of COIU is to assist OCA, INSD, the Director's Office, the Deputy Director's Office, executive management, and the operational divisions in accommodating congressional oversight and responding to external investigations and requests for information, while ensuring the FBI's mission, resources, and other equities are appropriately protected.

The Assistant General Counsel (AGC) will be assigned to COIU but be embedded in INSD. The primary responsibility of the embedded AGC is to provide legal advice and counsel to INSD regarding the FBI's engagements with and responses to external reviews and investigations, e.g., DOJ OIG and GAO, while also issue spotting and coordinating with OGC on other legal matters as they arise. Simultaneously, the embedded AGC will assist COIU with a review and analysis across all internal/external FBI productions (Congressional, GAO, OIG, FOIA, or otherwise, as applicable and in coordination with other attorneys in OGC).

Under the guidance of COIU leadership, the embedded AGC will work closely with personnel across the FBI, including all three branches of OGC, to provide legal support and guidance to INSD regarding external audits and investigations, litigation, and coordinate other discovery matters. Responsibilities include (1) legal review of document requests and productions; (2) assistance in scoping and prioritizing document requests; (3) attending opening and closing conferences as needed; (4) witness interview preparation and, as appropriate, interview attendance to protect FBI equities; (5) review of draft OIG/GAO reports for privilege issues and, where appropriate, assist in the drafting of FBI responses to those reports. The AGC will, along with other OGC colleagues, also be responsible for coordinating with counterparts across the FBI regarding related document productions, and analysis of information that has been disclosed as part of external audits/investigations, related congressional inquiries, and FOIA/civil litigation. The AGC will work closely with the Investigative Law Unit, who will continue to handle shooting reviews.

Job Description

GS-14:

· Provide legal advice to all levels of INSD management on a variety of subjects, activities, and functions concerning external audits and investigations, including inter alia:

o Reviewing, scoping, prioritizing, and responding to document requests.

o Attending opening and closing conferences.

o Preparing witnesses for interviews.

o Reviewing draft OIG/GAO reports.

o Advising on legal privilege issues.

· Identify and coordinate with other units within the Office of the General Counsel (OGC) on other legal issues impacting INSD that fall within the area of expertise and responsibility of those units, including inter alia:

o Coordinate with other attorneys within the Congressional Oversight & Investigation Unit (COIU) on legal issues impacting INSD that overlap with other external investigations and/or Bureau divisions.

o Coordinate with the Investigative Law Unit on legal issues impacting INSD that overlap with other legal matters and/or Bureau divisions.

GS-15: In addition to the above duties:

· Provide expert legal advice and guidance to the highest levels of FBI management on all aspects of external audits and investigations.

The ideal candidate will possess five years of substantive experience providing legal advice on government oversight and investigations, including internal investigations. Experience as agency counsel is beneficial.

Qualifications

Key Requirements:

• Must be able to obtain a Top-Secret/SCI clearance

• Selectee will be required to complete form FD-887, Request for Access to Sensitive Compartmented Information (SCI)

• Selectee will be required to complete a Confidential Financial Disclosure Report, OGE-450 annually.

BASIC REQUIREMENT: All applicants must possess a law degree from a law school accredited by the American Bar Association and be an active member of the bar (any US jurisdiction).

Positive Education Requirement: This position has a specific education requirement; all applicants must verify completion of this basic requirement by submitting both proof of JD degree and proof of good standing with a bar within a US jurisdiction. Education: Applicant must possess a J.D. degree from a law school accredited by the American Bar Association (or have a LLM degree or other graduate law school degree in addition to a J.D.) and be an active member of the bar (any US jurisdiction).

GS-14: Applicants applying for a GS-14 position must have 2.5 or more years post J.D. attorney experience.

GS-15: Applicants applying for a GS-15 position must have 4 or more years of post J.D. attorney experience.

· Limited Movement: Policy has been implemented wherein support employees entering a position through competitive OR non-competitive action may be precluded from moving to another position within the Bureau by means of reassignment or change to lower grade for a minimum of 12 months.

· On December 22, 2017, the President signed into law the Tax Cuts and Jobs Act. This law may impact your transfer.

o This legislation made previously non-taxed moving expenses reimbursements taxable as of January 1, 2018. Please see HR Link for the list of FBI's current understanding of the applicable tax changes. However, this may change upon receipt of official guidance from GSA and DOJ.

o Current law provides the FBI with the authority to compensate employees for much of the tax burden caused by a transfer through the Relocation Income Tax Allowance (RITA) process, in an effort to identify way to minimize the additional tax burden on transferring employees.

· Candidates receiving a transfer of physical location, whether at the expense of the FBI or not, will be required to complete a one-year commitment to the assignment, prior to moving to a new position at the FBI. The 12-month waiting period begins the day an employee reports for duty at the new location.

· Employees selected for positions at the GS-14 level or higher, as well as employees selected for positions where a transfer of location is required, will be processed through the name check program prior to being notified of their selection.

· Memorandum of Understanding: Work performed outside assigned duties (that would not normally be documented on a SF-50, i.e., back-up duties), has to be documented in detail by an immediate supervisor in order to receive full credit for amount of time worked in that position. If no documentation is furnished, no credit will be given for the time worked in that position. The following notations must be specified in the documentation (Memorandum of Understanding):

o Percent of time worked in the particular position (cannot conflict with main duties)

o The month/year work began

o Frequency worked (i.e., daily, monthly, etc.)
