About the Office

The Consumer Protection Branch (CPB) enforces federal consumer protection laws throughout the United States. CPB brings both criminal prosecutions and civil enforcement actions in matters of national importance related to complex consumer fraud schemes, prescription drug diversion, adulterated and misbranded products, deceptive trade practices, and data privacy. The Branch also defends against suits in district courts challenging consumer protection agencies’ regulatory actions. The Branch’s litigation regularly involves issues that attract congressional and media interest. CPB works closely with U.S. Attorneys’ Offices, other Main Justice components, and various federal law enforcement agencies. CPB also works extensively with the Food and Drug Administration, Federal Trade Commission, and Consumer Product Safety Commission.

Job Description

This vacancy announcement is open only to current Federal employees in the Department of Justice.

As the Assistant Director and Special Matters Coordinator for the Consumer Protection Branch, the incumbent generally will:

  • Supervise attorneys and staff in the handling and litigation of legal privilege matters and filter reviews, including matters that implicate the attorney-client or other privileges.  Advise attorneys and supervisors throughout the Branch on strategic approaches to identifying and handling issues related to privilege at all stages of civil and criminal investigations and litigation.  Handle and supervise filter and privilege-related litigation—including grand jury litigation—that may be necessary to ensure that such litigation is conducted appropriately and effectively.  Coordinate with Department components, partner agencies, and federal law enforcement agencies in the development and implementation of privilege and filter teams.
  • Establish and oversee uniform and efficient Branch policies and practices for information retention, collection, processing, maintenance, review, and production, especially with respect to electronic information.  Work closely with other Department components, partner agencies, and federal law enforcement partners on such efforts.  Serve as the Branch’s liaison to the Civil Division’s Office of Litigation Support and e-discovery support lab.
  • Supervise and handle litigation involving particularly difficult and complex discovery issues.
  • Design and manage the Branch’s record-management system, coordinating with appropriate Department components.
  • Serve as the Branch’s Professional Responsibility Officer.
  • Lead appropriate trainings for Branch personnel.
  • Assist and support the Director, Principal Deputy Director, and Deputy Directors by providing input on budget allocation, hiring, personnel actions, technology, administrative issues, and various Department reporting responsibilities.
Qualifications

Applicants must have a J.D. degree earned through graduation from a full course of study in a School of Law accredited by the American Bar Association and be a member in good standing of the bar of a state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

Applicants must have at least four years of post J.D. experience to qualify at the GS-15 level. You must also be a U.S. citizen. Applicants must have excellent writing and advocacy skills, as well as superior managerial, negotiation, and interpersonal skills. Successful applicants will be highly motivated, exhibit sound judgment, and have extensive litigation experience. Familiarity with the federal statutes enforced by the Consumer Protection Branch, federal court trial experience, familiarity with conducting investigations of individuals and corporations, and experience litigating and handling claims of privilege is strongly preferred.

The salary for the position is at the GS-15 level ($144,128.00 to $172,500.00 per year).

Suitability and Citizenship:  It is the policy of the Department to achieve a drug-free workplace and persons selected for employment will be required to pass a drug test which screens for illegal drug use prior to final appointment.  Employment is also contingent upon the completion and satisfactory adjudication of a background investigation. Congress generally prohibits agencies from employing non-citizens within the United States, except for a few narrow exceptions as set forth in the annual Appropriations Act (see, https://www.usajobs.gov/Help/working-in-government/non-citizens/). Pursuant to DOJ component policies, only U.S. citizens are eligible for employment with the Executive Office for Immigration Review, U.S. Trustee’s Offices, and the Federal Bureau of Investigation. However, please be advised that the appointment of non-U.S. citizens is extremely rare; such appointments would be possible only if necessary to accomplish the Department's mission and would be subject to strict security requirements. Candidates must have lived in the United States for at least three of the past five years. The three-year period is cumulative, not necessarily consecutive. Veterans:  There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Justice considers veterans' preference eligibility as a positive factor in attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., the DD 214, Certificate of Release or Discharge from Active Duty and other supporting documentation) to their submissions. Although the "point" system is not used, per se, applicants eligible to claim 10-point preference must submit Standard Form (SF) 15, Application for 10-Point Veteran Preference, and submit the supporting documentation required for the specific type of preference claimed (visit the OPM website, www.opm.gov/forms/pdf_fill/SF15.pdf for a copy of SF 15, which lists the types of 10-point preferences and the required supporting document(s). Applicants should note that SF 15 requires supporting documentation associated with service- connected disabilities or receipt of nonservice-connected disability pensions to be dated 1991 or later except in the case of service members submitting official statements or retirement orders from a branch of the Armed Forces showing that their retirement was due to a permanent service-connected disability or that they were transferred to the permanent disability retired list (the statement or retirement orders must indicate that the disability is 10% or more).
