  • Exemption 5, Deliberative Process Privilege:  "The Court will . . . grant EOUSA's Motion for Partial Summary Judgment with respect to its Exemption 5 redactions."  "[T]he Court has already held that these exact documents, from this exact request, contain no discussions that manifest any such misconduct[]" and, therefore, the court finds that Exemption 5's deliberative-process privilege is not superseded by the government-misconduct exception.
