Disposition:  Overruling plaintiff’s objections; adopting magistrate judge’s report and recommendation; granting defendant’s motion to dismiss

  • Litigation Considerations Pleadings:  The court adopts the magistrate judge’s report and recommendation.  The court relates that the magistrate judge found that “the remaining causes of action [which were, in part,] ostensibly brought under the [FOIA] . . . failed to state a plausible claim for relief.”  “In particular, [the magistrate judge] noted that claims under FOIA . . . must be targeted at specific agencies or contain specific allegations of agency noncompliance.”  “Because [plaintiff’s] claims were directed solely against the United States and did not contain the requisite allegations of agency failure, [the magistrate judge] recommended dismissal.”
