- Litigation Considerations, Adequacy of Search & Procedural Requirements, Proper FOIA Requests: The court holds that "[defendant's declarant] has . . . described a good-faith search reasonably calculated to locate responsive records maintained by EOUSA." The court relates that "[the declarant] 'personally reviewed the FOIA file and search notes,' retrieved [plaintiff's] 'physical files,' and 'performed a second, thorough search . . . for potentially responsive records.'" Finally, the court finds that "[defendant] was not required to answer [plaintiff's] questions or to opine about the 'evidence' he requested."
