  • Attorney Fees:  The court awards plaintiff $527.40 in costs.  "[The] Court finds persuasive the thorough opinion recently authored by Judge Feldman in which he concluded that [plaintiff] could not, as a pro se attorney, recover attorney's fees under the FOIA."  "Chief Judge Engelhardt has also adopted this opinion when holding that [plaintiff] cannot collect attorney's fees as a matter of law."  "The request for attorney's fees is denied."  "The Court notes, however, that both Judge Feldman and Judge Engelhardt awarded [plaintiff] the litigation costs that he requested."  "The Court is persuaded that [plaintiff] is entitled to litigation costs[]" because "the Court finds it more likely than not that the lawsuit served as a catalyst for at the very least the earlier record productions."
