Re: Requests concerning certain police officer positions
Disposition: Granting defendants' motion to dismiss
- Litigation Considerations, Mootness and Other grounds for Dismissal: Concerning three requests, the court relates that plaintiff only alleges that defendants mischaracterized their responses at the administrative level. The court finds that plaintiff's claims to this effect are moot. Regarding plaintiff's remaining requests at issue, the court finds that plaintiff received the records that he requested and therefore "he fails to identify any records withheld by the agency." Regarding a claim plaintiff made against the VA, the court finds that these records are "not . . . maintained by the VA." Regarding several administrative appeals that plaintiff alleges have not been decided, the court holds that "Plaintiff may reassert these counts in an amended complaint." Finally, the court finds that one count "is nonsensical." "It is unclear what documents, if any, were improperly withheld . . . ."
