Re:  Request for two emails involving Defense Base Act case

Disposition:  Denying plaintiff's motion for reconsideration

  • Exemption 4:  "The Court is unconvinced, and finds no clear error warranting reconsideration of its October 11, 2018 opinion."  The court previously found that one email was commercial and financial, obtained from a person, and privileged.  First "[t]hat [plaintiff] pointed to two subsequent 'disclosures' by [the submitter] allegedly reinforcing his argument does not change the fact that the legal basis he asserted for disclosure was the same."  "And second, the Court's denial of [plaintiff's] motion was not in clear error."  "[The] Court held that DOJ was not required to segregate from the e-mail and release words with minimal or no information content."  "The Circuit agreed."
