Rodriguez v. FBI, No. 16-02465, 2018 WL 999908 (D.D.C. Feb. 21, 2018) (Mehta, J.)

Re: Request for records concerning plaintiff

Disposition: Denying defendants' motion for summary judgment

  • Litigation Considerations, Adequacy of Search:  The court holds that "Defendants' declarations are insufficient for the court to conclude that the agency's approach in searching for documents responsive to Plaintiff's request 'was reasonably calculated to uncover all relevant documents.'"  "Without evidence of the search terms and method of search used by the Criminal Division, and an explanation for why [the one office searched] was the only location that housed responsive documents, the court finds that genuine issues remain about the adequacy of the search."
