Disposition:  Denying plaintiff's oral motion to clarify or amend the complaint

  • Litigation Considerations, Pleadings:  In response to the plaintiff's request for leave "to 'clarify' that the complaint alleges claims under Sections 552(a)(1) and (2) of FOIA[,]" the court holds that the "claims that [the plaintiff] now seeks leave to 'clarify' were not simply overlooked or misconstrued . . . they were not alleged in the complaint."  The court explains that the changes plaintiff proposes "are not modest corrections but would, instead, open entirely new vistas."  Such an "approach to litigation offers no end and is unfair to the opposing party."
