Speaking Truth to Power v. U.S. Nat'l Nuclear Sec. Admin., No. 14-1421, 2015 WL 3948102 (E.D. Pa. June 29, 2015) (Bartle, J.)
Re: Request for records concerning certain incidents involving nuclear weapons
Disposition: Granting defendant's motion for summary judgment
- Litigation Considerations, Adequacy of Search: The court "conclude[s] that [defendant] conducted a reasonable search for responsive records such that a grant of summary judgment is appropriate." The court finds that defendant "explained which repositories within [its] control were most likely to contain responsive documentation" and "detailed the search terms used and the type of searches performed within those repositories." "While the employee did not expressly state that 'all files likely to contain responsive materials ... were searched,' such magic words are not required when, as here, a reasonably detailed affidavit describes a thorough search of those places where responsive documentation is likely to be found."
