Date

Stecz-Hunter v. Dep't of Educ., No. 19-00142, 2019 WL 5963875 (N.D. Tex. Nov. 13, 2019) (Pittman, J.)

Re:  Request for complete copy of plaintiff's student loan consolidation promissory note

Disposition:  Granting defendant's motion to dismiss

  • Litigation Considerations, Adequacy of Search:  The court holds that "[plaintiff] received a letter from DOE . . . which included a copy of her consolidated promissory note, thus fulfilling her FOIA request and DOE's FOIA obligations."  "[Plaintiff] contends that her promissory note is incomplete because it does not include two pages she previously filled out which contained a list of outstanding loans."  "However as previously stated, the promissory note itself clearly states that the note will not contain a list of the amounts owed."  "Therefore, the Court finds that [plaintiff] failed to carry her burden of stating a claim for which the Court can grant relief."
