  • Exemption 5, Deliberative Process Privilege:  The Court of Appeals for the Ninth Circuit amends in part its prior May 12, 2022, opinion.  The court alters the phrase “‘deliberations regarding how best to address public relations matters or possible responses to an inquiry received from an outside entity are not the type of policy decisions the privilege is intended to protect’ . . . to . . . ‘deliberations regarding how best to address public relations matters or possible responses to an inquiry received from an outside entity’ are not necessarily the type of policy decisions the privilege covers.”
